Adoption Contract

Whenyou have met your kitten and decided to adopt and we have agreed to accept your application to adopt, and you have paid your non refundable $50 deposit, then its time to complete the adoption contract. Payment in full is required before you collect your kitten. Allow time for the deposit to reach our bank or provide evidence of payment on pick up. We recommend that you print the contract for your own records.

For and in consideration of Neonatal Kitten Rescue Hobart Ltd’s relinquishment of custody of the kitten (the Kitten), the above identified adopter (The Adopter) gives and grants to Neonatal Kitten Rescue Ltd, as the basis on which the kitten is released, this Adoption and Indemnity Agreement, and the Adopter promises, covenants and agrees as follows: Provision of love protection and care To care for the kitten lovingly including but not limited to the provision of adequate food, water, shelter, veterinary care, love and protection from danger. Not to sell, trade, or dispose of the Kitten in any way but in the event of choice or circumstances requiring the adopter to relinquish the Kitten that the Kitten be returned to Neonatal Kitten Rescue Hobart Ltd. Neonatal Kitten Rescue Hobart Ltd reserves the right to refund none or only a portion of the adopter’s adoption fee at the absolute discretion of Neonatal Kitten Rescue Hobart Ltd. The kitten shall not be used for any medical or experimental purposes, shall not be kept chained or tied and shall not be used for breeding. That if the kitten is not desexed and microchipped before its adoption, that the Adopter undertakes to have the Kitten desexed and microchipped as soon as it is deemed safe to do so by a veterinarian. That it is acknowledged that Neonatal Kitten Rescue Hobart Ltd reserves the right to make inquiries about the Kitten at any time, and if Neonatal Kitten Rescue Hobart Ltd reasonably believes that the Adopter has failed to keep the Kitten in accordance with the terms of this Agreement, then Neonatal Kitten Rescue Hobart Ltd may refer their concerns and provide details of the Adoption to the authorities without recourse by the Adopter. Undertakings by the Adopter 6. That should the kitten show signs of illness or disease within the first 14 days following the date of adoption, to promptly notify Neonatal Kitten Rescue Hobart Ltd and provide full details of the Kitten’s condition, and if required, to return the kitten to Neonatal Kitten Rescue Hobart Ltd or a veterinarian nominated by Neonatal Kitten Rescue Hobart Ltd 7. To promptly notify the microchip Registry of any change of address, telephone number or email address. 8. That all information contained on the Adopter’s Adoption application is true and correct. If any information contained on the Adopter’s adoption application is untrue, the Adopter expressly agrees that Neonatal Kitten Rescue Hobart Ltd may retake custody of the Kitten without refunding adoption fee and without recourse by the Adopter. Release from Indemnity 9. That Neonatal Kitten Rescue Hobart Ltd (and all of its directors, members and agents) shall not be liable to the Adopter for any injury, damage, or death directly or indirectly caused by the Kitten, or any action of negligence or tort arising out of the release and adoption of the kitten. 10. That it is acknowledged that the purpose of the release contained in paragraph 9 is to protect Neonatal Kitten Rescue Hobart Ltd (and all its directors, members and agents) from the consequences of any act by the kitten following its adoption, and the consequences of any act or omission of Neonatal Kitten Rescue Hobart Ltd in obtaining the kitten, providing care for the kitten and in adopting the kitten to the Adopter. No Warranties 11. That although best efforts have been made to ensure the proper health of the Kitten, the Adopter understands that Neonatal Kitten Rescue Hobart Ltd makes no warranties or representations (either express or implied) as to the health, fitness, demeanour or wellbeing of the Kitten. 12. That as a consequence of paragraph 11 Neonatal Kitten Rescue Hobart Ltd accepts no responsibility if the Kitten should become ill or die after being released to the Adopter, or should bite, scratch, injure or cause the death of any person or animal or cause damage to property after being released to the Adopter. Applicable Law 13. That this agreement shall be governed and construed in accordance with the laws of the state of Tasmania and 14. That any disputes between the parties to this Agreement concerning the subject matter of this Agreement shall be submitted for resolution to the courts of Tasmania. Other 15. Your Vaccination Certificate is provided 16. Any subsequent vaccinations are your responsibility and have not been prepaid in the adoption fee. Your Kitten has been vet checked and proclaimed healthy. 17. Please keep your kitten indoors or in a safely enclosed cat run. 18. Please continue the current diet your kitten is on as described by the Kittens current carer. Sudden changes to diet may cause stomach upset. 19.
